The Indian Parliament is the organ of the state in whose domain the same-sex marriage pleas should be raised. The Legislature, as an institution and a wing of the government, is a microcosm of the bigger social community possessing qualities of a democratic institution in terms of composition, diversity, and accountability.
The Kesavananda Bharati judgement (1973) by the Supreme Court introduced the Basic Structure Doctrine. It said that the Constitution could only be amended to the extent by the Parliament that it did not violate its basic features such as the supremacy of the Constitution, the secular nature of the state, the democratic structure, etc.
